Rental Agreement and Waiver

IMPORTANT: Before making your reservation, please ensure that you have sufficient space for our trailer. We require a flat, 8 foot x 20 foot area. In winter, this area must be plowed from snow. It can be a driveway or a yard, for example, but the space must meet these space requirements. If you want the sauna in your yard, keep in mind that your grass may be damaged by the tires, and Silver Creek Sauna will not be liable. We do our best to prevent grass damage.

  • Either the Lessee or the Additional Signee MUST be present for delivery. If neither are present at the time of delivery, Silver Creek Sauna Co will not complete delivery, and Lessee will not be refunded any amount for this cancellation. A second delivery time can be requested for an additional charge of $80 in our 12 mile radius, or an additional $2 per mile, one-way, as quoted in the original agreement.

    The Silver Creek Sauna Co Cancellation Policy is understanding and flexible. As many of our bookings are received well in advance, other customers may have been turned away because the saunas have already been reserved. All cancellations must be received in writing and refunds will be issued according to the following schedule:

    • 14 days or more prior to delivery, 25% of deposit retained

    • 7-13 days prior to delivery, 50% of deposit retained

    • 2-6 days before delivery, 75% of deposit retained

    • Day before or day of delivery, full deposit retained, no refund.

  • 1. MASTER AGREEMENT: The Lessee (as detailed below) and Lessor (Silver Creek Sauna Co.) acknowledge and agree that the terms and conditions contained in this agreement shall govern the rental of any and all equipment by the Lessee from the Lessor, and the term “Equipment” as used herein shall refer to all such equipment. Except as otherwise expressly agreed by the Lessor and Lessee in writing, in the event of a conflict between the terms and conditions contained in this agreement and any terms and conditions set out in any purchase order, acceptance or other document the Lessee and the Lessor agree that the terms and conditions set out in this agreement shall govern.

    2. RENTAL PERIOD: The rental period with respect to the Equipment shall commence on and include the actual day of delivery of the Equipment to the Lessee. The rental period shall end on and include the day of pick-up of the Equipment by the Lessor. The Lessee is responsible for the Equipment until it has been removed from the Lessee property. Rental rates are based on a rate schedule on Page 1 of this agreement.

    3. PAYMENT: The Rentals due under this Lease shall be paid in full in advance to the mailing address of the Lessor at the address designated on Page 1 of this agreement. The Lessor reserves the right to deny delivery of equipment in the event of failure to pay the Rental by the Lessee. A valid credit card pre-authorization will be kept on file for the duration of the rental in case of damage as a security.

    4. INSPECTION: Before the Equipment is delivered to the Lessee, the Lessor shall inspect and clean the Equipment to ensure it is in satisfactory condition prior to operation. If the Lessee does not inspect the Equipment upon delivery, the Lessee is conclusively deemed to have accepted that the Equipment is in good condition and working order, without broken or worn out parts and in clean and unmarred condition.

    5. MAINTENANCE, OPERATION AND REPAIRS: The Lessee shall not remove, alter, disfigure or cover up any numbering, lettering or insignia displayed upon any Equipment, and shall ensure that no Equipment is subjected to careless or needlessly rough usage and shall, at the Lessee’s own expense, maintain and ultimately return to the Lessor the Equipment and its appurtenances, together with any tools and accessories pertaining thereto, the whole in good repair and operating order.

    6. LOSS OR DAMAGE TO EQUIPMENT: The Lessee shall indemnify and hold harmless the Lessor against all loss and damage to the Equipment (listed in Section V) during the rental period and the appraisal for any such loss or damage shall be based upon the replacement cost of the Equipment without deduction or depreciation. The Lessee shall be liable for all resulting loss or damage to the Equipment and expense of the Lessor to the extent that it: a) results from the gross negligence of the Lessee which included, but is not limited to, the use or operation of the equipment in a reckless or abusive manner or, intentional damage to the Equipment by the Lessee or by the Lessee’s permission or, b) occurs under either of the following circumstances: i) All loss or damage associated with vandalism, malicious mischief, theft or conversion of the equipment; and/or ii) All loss or damage associated with Equipment being overloaded, operated above rated capacity or if operating instructions are not followed. 

    7. LIABILITY OF THE LESSEE: The lessee shall indemnify and hold harmless the Lessor against all loss, expenses, penalties, damages, condemnations and legal costs which the Lessor may suffer or may be required or condemned to pay for personal injury (including death) and/or property damages suffered by any person by reason of the Equipment or the operation, handling, transportation or use thereof by or while rented by the Lessee. The Lessee shall maintain at the Lessee’s own expense, public liability and all risk property insurance in adequate amounts to fully cover the indemnity. The Lessee hereby renounces all claims which he (it) may have against the Lessor for any loss or damage which he (it) may suffer, either directly or indirectly, by reason of the condition of the Equipment or its suitability for the operation it may be required to perform.

    8. TITLE: Title to the Equipment shall at all times be and remain vested in the Lessor and nothing contained in this Lease shall be deemed to have the effect of conferring upon the Lessee any right or title whatsoever in or to the Equipment, other than that of the Lessee. The Lessee shall not incur or permit to exist any lien or other encumbrance on or with respect to the Equipment. The Lessee shall give the Lessor immediate notice in case of any Equipment that is levied upon or from any cause becomes liable to seizure.

    9. SUBLETTING AND LOCATION: None of the Equipment shall be sublet by the Lessee, nor shall he (it) assign transfer any interest in this Lease without the previous consent of the Lessor. The Equipment shall be used at the location where delivered to by the Lessor.

    10. WARRANTIES: The Lessor makes no warranties, either expressed nor implied, as to any matter whatsoever, including, without limitation, the condition of the Equipment, its merchantability or fitness for a particular purpose or, that it is suited for the Lessee’s intended use. The aggregate liability of the Lessor hereunder, if any, shall be limited to the amount paid to it by the Lessee under this lease. This represents the entire agreement between the parties with respect to the Equipment. The Lessor reserves the right to refuse service to any person(s) without warning, reason, or cause at any time.

    11. CHOICE OF LAW, JURISDICTION AND VENUE: This Agreement shall be governed by, construed and enforced in accordance with the laws of the State of Minnesota. The parties agree that Hennepin County, MN. will be the venue of any dispute and will have jurisdiction over all parties.

    12. DISPUTES: Any disputes or claims less than $15,000 will be resolved in conciliation court.

  • 1. Never allow sauna to exceed 200°F (71°C). Check the thermometer inside of the sauna at least every 30 minutes. If temperature reaches over 200°F, immediately open the door and leave the door open until temperature drops to 180°F or below;

    2. Limit sauna time to 20 mins at a time; 

    3. Use a buddy system when using the sauna and avoid using it alone;

    4. Do not allow children to use the sauna without supervision and limit sauna time to 10 mins at a time and/or reduce the sauna temperature (should not be used by children under the age of five years of age (5yrs);

    5. Never allow anyone who has been drinking alcohol or using any kind of drugs (prescribed or otherwise) to enter the sauna;

    6. We have implemented protocols for regularly cleaning and disinfecting: i) Before each delivery, the sauna will be completely cleaned and disinfected before delivered to you.

    7. All Silver Creek Sauna Co. customers are strongly encouraged to follow these guidelines:) i)Sit on a towel during your sauna session, ii) make sure to maybe rinse off before the sauna session and cold plunge session to help keep any oils, lotions etc out of the sauna and plunge. 

    8. Persons with skin, ear, genital or other body infections should not enter the sauna because of the possibility of spreading infection;

    9. Persons with heart disease, diabetes, high or low blood pressure, any serious illness, pregnant women and any person with any doubt should not enter the sauna without prior consultation with a physician;

    10. Do not operate any electrical device inside of the sauna. Electrical shock or electrocution can occur in a sauna if live electrical current (including current from a telephone) comes into contact with water, heat, and/or humidity. Use a “Ground Fault Circuit Interrupter (GFCI) on any appliance that must be near the sauna;

    11. You and/or your guests will most likely be barefoot while near the sauna. Use only unbreakable dishes, beverage containers and utensils around the sauna and never use glass anywhere near or in the sauna.

    12. To avoid slip and fall injuries, wear sandals or flip flops outside of the sauna. Watch your step when entering and exiting the sauna. Please rinse feet in our included foot rinse tub before entering the sauna: this helps keep the sauna floor clean and reduces debris.

    13. Never use the sauna during a thunderstorm or when lightning is occurring in your area;

    14. Ultimately, it is the responsibility of the Lessee to ensure that all users of the sauna are aware of, and abide by this safety information including anyone charged with the responsibility of controlling access to the sauna – even if only temporarily.

  • Your Silver Creek sauna Co. professional will arrive at your delivery time and place the sauna trailer in your chosen 8-foot by 20-foot flat space. The Lessee who has signed this contract should be present, and our professional will give instructions and answer questions. 

    IMPORTANT: Before starting a fire, slightly open the ash pan about an inch. This is below the access door in front of the wood stove. This will act as your damper, and give the fire air, and help get it started. 

    Starting the sauna is as simple as starting a fire. The stove access door is in front of the wood stove. 

    1) Place an included fire-starter (Newspaper or birch bark) in the stove. IMPORTANT: Never use gasoline, kerosene, or any other highly flammable material as a fire starter.

    2) Place small sticks, split logs, or other such kindling on top of the fire-starter (newspaper), and then place 1 or 2 standard pieces of firewood on top of the kindling.

    3) Use a match or lighter to ignite the fire starter.

    4) Make sure some of the kindling has ignited, then close the stove access door.

    5) Wait 5 to 10 minutes, and you should see smoke rising from the chimney.

    6) Open the stove access door and confirm that the fire has fully started.

    7) Go back into the sauna and close the ash pan (damper) just a little bit. Closing the ash pan restricts some airflow to the fire if all the way closed the fire will go out. So keep it at a small crack that way the sauna will stay at the desired temperature for longer. The damper could be hot and could cause severe burns, so gloves or a damp towel are highly recommended when adjusting the ash pan (damper). This is where the Ash pan (Damper) will remain for this sauna session. (If the fire goes out and you want to start another session, repeat steps #1-6.)

    8)Your sauna is now stoking! It takes approximately 1-2 hours for the sauna to reach 140-170°F, which is the desired range of temperature. Keep the sauna door closed!

    9) During this 1 hour of stoking, you will likely need to add some pieces of firewood. Go into the sauna periodically during the stoking period and check the thermometer. Do not exceed 190°F.

    10) Barrel saunas are heat-efficient and require only small amounts of firewood. Only add 1-2 logs every 30-60 mins to maintain the desired temperature during each session.

    11) Limit time in the sauna to 20 minutes or less per sitting, cooling off outside, drinking water, and dunking in water to cool off between each 20-minute sitting.

    Lessee Signature: IMPORTANT: Either the Lessee or Additional Signee MUST be present at the time of delivery. See Section I. I, the undersigned, acknowledge and agree to the following:1. I have read the Silver Creek Sauna Co Terms and conditions of this agreement and agree to them. I am 18 years of age or older with a valid credit card and I am the owner or legal renter of the property at the address in Section I above.2. I have read the Safety and Instructions information of this agreement and understand the risks associated with the use of a sauna.3. I understand and approve that my credit card will be charged for the amounts listed in Section III above.4. I understand and approve that my credit card will be charged for the amounts indicated at Section V above for equipment in the event that they are damaged while rented to me. I understand that by signing below I have given up substantial rights on behalf of myself and others utilizing the sauna as part of this rental agreement.*
